SPECIAL DAMAGE ASSESSMENT


 

1.       Once liability has been established, the focus of the case assesses the special damages that plaintiff is entitled to be awarded.

 

2.       Special Damages are those damages that can be calculated or otherwise assessed based upon the historical facts of the injured parties in the case.

 

3.       Dirk von Guenthner has provided Special Damages assessments for:

 

          a.       Lost Wages;

          b.       Lost Profits;

          c.        Dust Damage;

          d.       Flood Damage;

          e.       Damaged structures;

          f.        Inventory losses;

          g.       Theft;

          h.       Embezzlement; and

          i.         Wrongful death.

 

4.       Where an economist will take a limited number of facts and opine on the damages of an injured party, Dirk von Guenthner requires counsel to provide him with as much information as is available in order to evaluate the entire issues of the matter. The documents received are organized and indexed to allow Dirk to reference noteworthy issues and documents in his expert report.

 

5.       Dirk has done substantially more Plaintiff cases on special damages and is increasingly being hired to provide expert reports on behalf of Defendant(s) to include rebuttal reports on Plaintiffs’ expert report.

 

6.       Special damages are based on a series of assumptions of the expert in order to identify a loss amount, if the assumptions change, the loss amount will change accordingly.
